TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of Mnemarch ("the Service"), a memory training application based on the Method of Loci, operated by an individual developer based in Japan ("we", "us").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

Mnemarch provides tools for practicing memory techniques: creating routes and places, memorizing word lists, and tracking your training results over time.

The Service is a training tool. While the Method of Loci is a well-established technique, we do not guarantee any specific improvement in memory or any particular training outcome.

The app itself is distributed through the Apple App Store under Apple's standard Licensed Application End User License Agreement (the "Apple EULA"), which governs your license to use the software. These Terms instead cover your use of the Service — your account, your content, and any paid features — and do not replace the Apple EULA.

2. Your Account

You must provide accurate information when creating an account and keep your sign-in credentials secure. You are responsible for all activity that occurs under your account.

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Service.

3. Acceptable Use

You agree not to: attempt to gain unauthorized access to the Service or other users' data; interfere with or disrupt the operation of the Service; scrape, crawl, or bulk-extract data from the Service; reverse engineer the Service except where permitted by law; or store unlawful content in your routes, places, or word lists.

4. Your Content

You retain ownership of the content you create in the Service, such as your routes, places, and word lists.

You grant us a limited license to host, store, and process that content solely as needed to operate and improve the Service. We do not use your content for advertising or share it with third parties except as described in our Privacy Policy.

5. Our Intellectual Property

The Service itself — including its software, design, and branding — remains our property or that of our licensors. These Terms do not grant you any right to use the Mnemarch name or branding.

6. Purchases and Subscriptions

The Service offers paid features through in-app purchases. Payments are billed through the Apple App Store, and refunds are handled according to Apple's policies. A subscription renews automatically until you cancel it, and you can manage or cancel it at any time in your App Store account settings. Deleting your Mnemarch account does not cancel a subscription.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at any time.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or training records.

Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer protection law in your jurisdiction.

9. Termination

You may stop using the Service and delete your account at any time using the Delete Account option in the app settings.

We may suspend or terminate your access to the Service if you materially breach these Terms. Where reasonable, we will notify you before doing so.

10. Changes to These Terms

We may revise these Terms from time to time. The "Updated" date at the top of this page shows when they were last revised. Material changes will be announced within the app or on this website before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the Japanese court having jurisdiction over the location of the operator, except where mandatory law provides otherwise.

This applies to your use of the Service under these Terms only. Your license to use the app software itself is governed separately by the Apple EULA referenced in Section 1, which is subject to its own governing law.
